Terms and Conditions

THE UNIT FITNESS

MEMBERSHIP TERMS AND CONDITIONS

These Terms and Conditions apply to membership and use of facilities at The Unit Fitness gyms, including Honley, Elland, Halifax, Saddleworth and Leeds Road.

The Unit Fitness is a trading brand used by the businesses operating these gyms. Each membership contract is entered into with the legal company operating the member’s chosen location, as identified during registration and in their membership confirmation.

By joining The Unit Fitness, members agree to comply with these Terms and Conditions and any applicable Club Rules made available before joining.

The Unit Fitness is committed to providing safe, clean, professional and well-maintained facilities for all members.

1. MEMBERSHIP AND PAYMENTS

1.1 Membership fees are payable monthly in advance unless an alternative payment arrangement has been agreed.

1.2 Membership payments will be collected on the agreed payment date.

1.3 Members are responsible for maintaining valid payment details and ensuring sufficient funds are available.

1.4 Where a membership payment fails, The Unit Fitness may temporarily suspend access after notifying the member and providing a reasonable opportunity to resolve the outstanding payment.

1.5 Continued failure to pay membership fees lawfully due may result in termination and appropriate debt recovery action.

1.6 Membership fees may be increased following a minimum of two months’ written notice. Fixed-term membership prices will not increase during the agreed minimum term unless a fair and clearly disclosed variation provision permits this.

1.7 Members on rolling contracts may cancel without penalty before a price increase takes effect.

1.8 Memberships are personal and cannot be transferred, shared or used by another person.

1.9 Members must provide accurate registration information and keep their contact details updated.

2. MEMBERSHIP CONTRACTS

2.1 Where a member joins on a 12-month membership, they agree to an initial minimum contractual period of 12 months.

2.2 Membership fees remain payable throughout the minimum period, subject to statutory rights and the exceptions within these Terms and Conditions.

2.3 Members may request early cancellation where continued membership would be unreasonable due to serious illness, injury, disability, significant financial hardship or other exceptional circumstances.

2.4 The Unit Fitness will consider such requests fairly and may request reasonable supporting evidence.

2.5 Following the minimum contractual period, memberships will continue monthly where this was clearly disclosed and agreed at sign-up.

2.6 Rolling memberships may be cancelled by providing one month’s written notice.

2.7 Members may give notice before their minimum term ends, with cancellation taking effect at the end of the agreed period.

2.8 Nothing in this agreement removes statutory cancellation rights.

3. MEMBERSHIP SUSPENSIONS AND FREEZES

3.1 Members may request to temporarily suspend their membership for medical reasons, injury, travel or other exceptional circumstances.

3.2 Under the standard suspension policy, memberships may be suspended for a maximum of six months in any rolling 12-month period.

3.3 Suspension requests must be submitted in writing and approved before taking effect.

3.4 Members should normally provide at least one month’s notice.

3.5 Suspensions will not normally be applied retrospectively unless exceptional circumstances justify doing so.

3.6 Where a suspension is approved, The Unit Fitness will confirm the dates, any applicable fees and the effect on the minimum contractual period.

3.7 Requests exceeding six months will be considered individually where required by law or justified by exceptional circumstances, including disability or serious illness.

3.8 The Unit Fitness may request reasonable supporting evidence.

3.9 Where continued membership is unreasonable because of serious illness, disability or significant financial hardship, early cancellation may be considered instead of suspension.

3.10 An approved freeze will not automatically cancel a membership.

4. GENERAL CONDUCT AND BEHAVIOUR

4.1 Members must treat staff, other members, visitors and Club property with respect.

4.2 Members must comply with reasonable instructions from authorised management and staff.

4.3 The following behaviour is prohibited:

  • Violence, threats or intimidation.
  • Verbal abuse or threatening language directed towards others.
  • Harassment, bullying or discrimination.
  • Sexual harassment or inappropriate sexual conduct.
  • Theft, vandalism or deliberate property damage.
  • Reckless or dangerous use of equipment.
  • Deliberately creating hazards.
  • Fraudulent use of memberships or access systems.
  • Repeated disregard of Club rules.
  • Conduct creating a serious risk to safety or security.

4.4 Management may investigate reported incidents and take proportionate disciplinary action.

4.5 Depending on the seriousness of the breach, action may include a verbal warning, written warning, temporary suspension or membership termination.

4.6 Serious misconduct may result in immediate suspension pending investigation.

4.7 Members will normally be given an opportunity to respond before a final termination decision.

5. PERSONAL HYGIENE AND CLEANLINESS

5.1 Members must maintain reasonable standards of personal hygiene and cleanliness when using Club facilities.

5.2 Members must wear appropriate, reasonably clean exercise clothing and footwear.

5.3 Members must use equipment hygienically and wipe down equipment after use where required by Club rules.

5.4 Members must use towels or other hygiene measures where reasonably required by the facility.

5.5 Where persistent or particularly serious hygiene concerns materially affect other members’ reasonable enjoyment of the facilities, management may address the matter privately with the member concerned.

5.6 Members will normally be given a reasonable opportunity to resolve hygiene concerns before disciplinary action is taken.

5.7 Persistent failure to address reasonable hygiene concerns may result in warnings, suspension or membership termination where proportionate.

5.8 The Unit Fitness will consider relevant medical conditions, disabilities and reasonable adjustments before taking disciplinary action.

5.9 Hygiene complaints will be handled discreetly and respectfully.

5.10 Members must not deliberately leave equipment, changing rooms, toilets or other facilities in an unhygienic condition.

6. RE-RACKING WEIGHTS AND EQUIPMENT USE

6.1 All members must return dumbbells, barbells, weight plates and other equipment to their designated storage areas immediately after use.

6.2 Equipment must not be left where it could roll, fall, obstruct walkways or create a hazard.

6.3 Members must use equipment safely and in accordance with its intended purpose.

6.4 Equipment must not be deliberately dropped, thrown, dragged or misused in a manner likely to cause damage or injury. Normal use of designated lifting equipment and areas is permitted in accordance with Club rules.

6.5 Members must report damaged, defective or unsafe equipment to management as soon as reasonably practicable.

6.6 Repeated failure to re-rack weights or follow reasonable equipment rules may result in disciplinary action.

6.7 Members who repeatedly ignore warnings about equipment misuse or re-racking may have their membership terminated where proportionate.

6.8 Where unsafe behaviour creates an immediate risk, management may suspend access pending investigation without issuing a prior warning.

6.9 Members must not interfere with equipment safety mechanisms or attempt unauthorised repairs or modifications.

7. DAMAGE TO GYM PROPERTY

7.1 Members are responsible for taking reasonable care when using all equipment, mirrors, flooring, fixtures, fittings and facilities.

7.2 Where a member causes damage through negligence, deliberate misconduct, reckless behaviour or misuse of equipment, they will be responsible for the reasonable and legally recoverable costs resulting from that damage.

7.3 Recoverable costs may include:

  • Repairing damaged equipment or property.
  • Replacing equipment or property where repair is not reasonably economical.
  • Necessary labour and installation.
  • Other direct, reasonably foreseeable and legally recoverable losses.

7.4 Members must report damage or equipment failure to management as soon as reasonably practicable.

7.5 Failure to report damage may be considered when assessing conduct but does not automatically establish financial liability.

7.6 The Unit Fitness may investigate incidents using lawfully obtained CCTV footage, witness statements, incident reports and other relevant evidence.

7.7 Where The Unit Fitness believes a member is responsible for damage, the member will receive an explanation of the incident and a reasonable breakdown of the costs claimed.

7.8 Members will be given a reasonable opportunity to respond and dispute responsibility.

7.9 Where liability is established, The Unit Fitness may issue an invoice for reasonable recoverable losses.

7.10 Failure to pay an established and lawfully due amount may result in appropriate debt recovery action.

7.11 Deliberate damage or serious misuse of equipment may result in immediate suspension and membership termination, independently of any claim for compensation.

7.12 Members will not be charged for ordinary wear and tear, equipment defects or accidental damage where they have not breached a legal duty.

7.13 No automatic fines or fixed financial penalties will be imposed for accidental damage.

7.14 Any claim will reflect actual recoverable losses, taking account of insurance recoveries, recoverable VAT and the condition of the damaged property.

8. PHOTOGRAPHY, VIDEO RECORDING AND SMART GLASSES

8.1 Members must respect the privacy and dignity of other members, staff and visitors.

8.2 Photographing, filming or audio-recording another identifiable individual without their permission is prohibited, except where expressly authorised by management or otherwise required or permitted by law.

8.3 Covert or concealed recording of other members or staff is strictly prohibited.

8.4 These rules apply to all recording devices, including:

  • Mobile phones.
  • Cameras.
  • Smart glasses, including Meta Ray-Ban glasses.
  • Body cameras.
  • Wearable recording devices.
  • Other technology capable of capturing images, video or audio.

8.5 Recording devices must not be used to capture images, video or audio in changing rooms, toilets or showers.

8.6 Members taking progress photographs or recording their own training must take reasonable steps to avoid capturing others without permission.

8.7 Members must stop recording immediately when reasonably instructed by management.

8.8 Recording for commercial, promotional or professional purposes requires prior management authorisation.

8.9 Members must not publish photographs or recordings intended to harass, humiliate, intimidate or deliberately expose another individual.

8.10 Serious breaches, including covert filming, harassment or recording in private areas, may result in immediate suspension and termination following appropriate investigation.

8.11 Where appropriate, incidents may be reported to the police or relevant authorities.

8.12 Management may require recording functions on smart glasses or wearable devices to be disabled within the gym.

8.13 Smart glasses and other wearable recording devices must not be used for recording in changing rooms, showers or toilets. Reasonable accessibility requirements will be considered when applying device restrictions.

9. MEMBERSHIP SHARING AND UNAUTHORISED ENTRY

9.1 All memberships are strictly personal and may only be used by the registered member.

9.2 Members must not share, lend, sell or transfer their membership card, QR code, PIN, access code or other entry credentials.

9.4 This includes:

  • Deliberately allowing another person through a turnstile.
  • Holding open a controlled entrance to admit an unauthorised person.
  • Allowing someone else to use a membership card or QR code.
  • Sharing access codes or entry credentials.
  • Deliberately bypassing the Club’s access system.

9.5 Deliberately providing unauthorised access is considered serious misconduct.

9.6 Where a serious or deliberate breach is established, The Unit Fitness may terminate membership without a prior warning.

9.7 Members may be responsible for reasonable, legally recoverable losses directly caused by their deliberate or negligent provision of unauthorised access.

9.8 CCTV and access-control records may be reviewed to investigate suspected membership misuse in accordance with applicable data protection requirements.

9.9 Members must report suspected misuse of their access credentials as soon as reasonably practicable.

9.10 Members must not bring unauthorised guests, children or spectators into restricted gym areas.

10. SUSPENSION, TERMINATION AND BANNING MEMBERS

10.1 The Unit Fitness may suspend or terminate membership where there are reasonable grounds supported by evidence of serious misconduct or a significant breach of these Terms and Conditions.

10.2 Grounds may include:

  • Deliberate or reckless damage to Club property.
  • Serious or repeated misuse of equipment.
  • Violence, threats or intimidation.
  • Harassment, bullying or discrimination.

  • Deliberate interference with fire exits or safety equipment.
  • Continued failure to pay sums lawfully due following reasonable notice.

10.3 Management may immediately suspend access where reasonably necessary to protect staff, members, visitors or property while an incident is investigated.

10.4 Before a final decision is made, management will consider the evidence, seriousness of the incident, previous warnings and any relevant explanation or mitigating circumstances.

10.5 Where misconduct is sufficiently serious, membership may be terminated without a prior warning.

10.6 Members will be notified of termination decisions in writing, including the effective date.

10.7 Refunds of prepaid membership fees will be determined fairly in accordance with applicable consumer law.

10.8 Where The Unit Fitness terminates membership for reasons unrelated to member misconduct, prepaid fees for services not provided will be refunded.

10.9 Following lawful termination, permission to enter the relevant Club premises may be withdrawn.

10.10 Where misconduct presents a genuine safety or security concern affecting other Unit Fitness locations, access restrictions at those locations may also be considered, subject to the relevant contractual arrangements and a proportionate assessment.

10.11 Members may request a review of a termination decision in writing within 14 days.

10.12 Refusing to pay a genuinely disputed damage claim or exercising statutory or legal rights will not, by itself, constitute grounds for disciplinary action.

11. CCTV AND SECURITY

11.1 CCTV operates within designated areas of The Unit Fitness premises for legitimate safety, security, crime prevention and property protection purposes.

11.2 CCTV may be reviewed where reasonably necessary to investigate accidents, complaints, damage, theft, suspected misconduct or safety incidents.
